1. Introductory Provisions

1.1 These General Terms and Conditions (hereinafter the "Terms") govern the mutual rights and obligations between ROAD 66, s. r. o., with its registered seat at ul. Družby 322, 976 98 Lopej, Company ID: 50390422, registered in the Commercial Register of the District Court Banská Bystrica, Section: Sro, Insert No. 30108/S (hereinafter the "Seller") and the buyer (hereinafter the "Buyer"), arising in connection with or on the basis of a purchase contract concluded between the Seller and the Buyer through the Seller's online store located at www.originalskroute66.sk (hereinafter the "e-shop").

1.2 For the purposes of these Terms, a consumer means a natural person who, when concluding and performing a consumer contract, does not act within the scope of their business activity, employment or profession.

1.3 These Terms apply to distance contracts within the meaning of Section 14 et seq. of Act No. 108/2024 Coll. on Consumer Protection (hereinafter the "Consumer Protection Act").

1.4 Legal relations not governed by these Terms are subject in particular to Act No. 40/1964 Coll. Civil Code, Act No. 250/2007 Coll. on Consumer Protection, Act No. 108/2024 Coll. on Consumer Protection and Act No. 22/2004 Coll. on Electronic Commerce, as amended.

2. Order and Conclusion of the Purchase Contract

2.1 The Buyer places an order for goods through the e-shop by completing and submitting the order form.

2.2 Before submitting the order, the Buyer has the opportunity to review and change the information entered into the order.

2.3 By submitting the order, the Buyer confirms that they have read and agree to these Terms.

2.4 A purchase contract between the Seller and the Buyer is concluded upon the Seller's binding confirmation of the order, sent to the Buyer by email.

2.5 The Seller reserves the right to verify the order by phone or email in case of doubts as to its authenticity.

2.6 If the Seller is unable to fulfil the order due to force majeure, unavailability of goods, or a significant price change, the Seller shall inform the Buyer without undue delay.

2.7 For the purposes of these Terms, force majeure means an extraordinary, unavoidable and unforeseeable event beyond the Seller's control.

3. Purchase Price and Payment Terms

3.1 Prices of goods listed in the e-shop are final and valid at the time the order is submitted.

3.2 Delivery and shipping costs may be added to the price of the goods and will be communicated to the Buyer before the order is submitted.

3.3 The Buyer may pay the purchase price and delivery costs by the following methods:

  • bank transfer in advance, based on instructions sent by the Seller after order confirmation,
  • cash on delivery – in cash or by payment card upon receipt of the goods from the courier,
  • in cash or by payment card upon personal collection of the goods.

3.4 In the case of advance payment by bank transfer, the goods are shipped only after the full purchase price has been credited to the Seller's account.

4. Delivery Terms

4.1 The goods are delivered within the period stated for each item in the e-shop, unless stated otherwise.

4.2 The place of delivery is determined by the Buyer in the order.

4.3 The Seller shall hand over the goods to the Buyer, or to the carrier for transport to the Buyer, within the agreed period.

5. Withdrawal from the Purchase Contract

5.1 A Buyer who is a consumer has the right to withdraw from a distance purchase contract without giving a reason within 14 days from the date of receipt of the goods, in accordance with Section 19 of the Consumer Protection Act.

5.2 If the subject of the purchase contract is the delivery of several types of goods or delivery in several parts, the withdrawal period runs from the date of receipt of the last delivery of goods.

5.3 The Buyer may exercise the right of withdrawal in writing at the Seller's registered address or by email to eshop@originalskroute66.sk, by means of an unambiguous statement. For this purpose, the Buyer may use the model withdrawal form, which is Annex No. 1 to these Terms.

5.4 The withdrawal period is deemed observed if the Buyer sends the notice of withdrawal before the 14-day period expires.

5.5 The Buyer is obliged to send the goods back or hand them over to the Seller no later than 14 days from the date of withdrawal from the contract. The costs of returning the goods shall be borne by the Buyer.

5.6 The Seller shall refund the Buyer all payments received under the contract (including delivery costs corresponding to the cheapest standard method of delivery offered by the Seller), without undue delay and no later than 14 days from the date of receipt of the notice of withdrawal.

5.7 The refund will be made using the same payment method as used by the Buyer, unless expressly agreed otherwise, without charging any additional fees.

5.8 The Seller is not obliged to refund the payment before the goods are delivered back, or before the Buyer proves that the goods have been sent back, whichever occurs first.

5.9 The Buyer is liable for any diminished value of the goods resulting from handling the goods in a manner beyond what is necessary to establish the nature, characteristics and functioning of the goods.

5.10 The Buyer may not withdraw from a contract the subject of which is, in particular, the sale of goods made to the Buyer's specific requirements or custom-made goods, as well as in other cases set out in Section 19(8) of the Consumer Protection Act.

6. Liability for Defects and Complaints

6.1 The Seller is liable for defects present in the goods at the time of receipt by the Buyer, as well as for defects that occur after receipt of the goods during the warranty period.

6.2 The following are not considered defects: normal wear and tear caused by use, mechanical damage caused by the Buyer, improper use, improper maintenance, or natural variations in materials.

6.3 For textile products, the Buyer is obliged to follow the recommended washing, cleaning and care instructions. Damage caused by improper care is not grounds for accepting a complaint.

6.4 The warranty period is 24 months from the date of receipt of the goods, unless stated otherwise for a specific item.

6.5 The Buyer may file a complaint in writing at the Seller's registered address or by email to eshop@originalskroute66.sk. For this purpose, the Buyer may use the complaint form, which is Annex No. 2 to these Terms.

6.6 Upon filing a complaint, the Seller shall issue a confirmation to the Buyer and shall decide on the complaint no later than 30 days from the date it was filed.

6.7 The Buyer's rights in exercising liability for defects are governed by the relevant provisions of the Civil Code and Act No. 250/2007 Coll. on Consumer Protection.

7. Gifts, Discounts and Promotions

7.1 The Seller may provide discounts, promotional prices, or gifts with orders.

7.2 Discounts may not be combined with one another unless expressly stated otherwise.

7.3 If the Buyer withdraws from a contract under which a gift was provided, the Buyer is obliged to return the gift together with the goods.

8. Intellectual Property Rights and Brand Protection

8.1 The designations SK Route 66®, EU Route 66®, Route 66®, logos, graphic elements, designs, photographs, texts and other content of the e-shop are protected by the relevant intellectual property rights or by the rights of authorized parties.

8.2 Without the Seller's prior written consent, it is not permitted to use, copy, distribute, modify or commercially exploit the logos, designations, photographs, texts or designs contained in the e-shop.

8.3 By purchasing a product, the Buyer does not acquire any rights to any trademark, logo, designation or design, other than the right to use the purchased product in the usual manner.

8.4 The Seller points out that the sale of unofficial, imitation, or improperly marked Route 66 products may constitute an infringement of intellectual property rights.

9. Personal Data Protection

9.1 The processing of the Buyer's personal data is governed by the Seller's Privacy Policy, available on the website www.originalskroute66.sk.

9.2 Details on the use of cookies on the e-shop are set out in the cookie banner on the website and in the Privacy Policy.

10. Alternative Dispute Resolution

10.1 If a Buyer who is a consumer is not satisfied with the way the Seller handled their complaint, or believes that the Seller has violated their rights, the Buyer has the right to contact the Seller with a request for remedy.

10.2 If the Seller responds negatively to a request under point 10.1, or fails to respond within 30 days of its submission, the Buyer has the right to submit a proposal to initiate alternative dispute resolution to an alternative dispute resolution entity (hereinafter an "ADR entity") pursuant to Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes. A list of ADR entities is available on the website of the Ministry of Economy of the Slovak Republic. The Slovak Trade Inspection is also a competent entity and can be contacted via www.soi.sk.

10.3 The Buyer may also use the Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr/, to submit a proposal for alternative dispute resolution.

12. Final Provisions

12.1 These Terms become effective on the date of their publication on the Seller's website.

12.2 The Seller reserves the right to amend these Terms. An amendment to the Terms does not affect purchase contracts concluded while the previous version of the Terms was in effect.

12.3 These Terms and the relationship between the Seller and the Buyer are governed by the laws of the Slovak Republic.

12.4 If any provision of these Terms is or becomes invalid or ineffective, this shall not affect the remaining provisions, which shall remain valid and effective.

12.5 The Seller does not provide the Buyer with after-sales service, unless stated otherwise for a specific item.
